Terms and Conditions
  1. Offer applies to approved Fleet customers only. Vehicles must have been purchased and registered in 2008 with the correct Fleet code designated by Alfa Romeo UK (Anagraphic Code).
  2. To benefit from the offer, the customer must contact the Alfa Romeo UK helpline (telephone 0800 0234 159) within 2 working days of the breakdown unless Alfa Romeo UK has already contacted the customer.
  3. The customer must also contact the AA to request recovery of their own vehicle and to arrange for it to be repaired by an authorised Alfa Romeo UK dealership. The customer must provide their contact details to the AA. and comply with any conditions of the AA’s rental company.
  4. If the repair of the customer’s vehicle takes longer than 48 hours, Alfa Romeo UK will either cover the costs to extend the free of charge period of the AA courtesy vehicle by a further period up to 48 hours or, subject to availability, provide a courtesy Alfa 159 up to a maximum of 60 days.
  5. Alfa Romeo UK will be responsible for:
    1. the hire costs of the courtesy vehicle for the duration of the repair only;
    2. paying the cost of third party insurance for the AA courtesy vehicle during any extended loan period; and
    3. arranging third party insurance for any Alfa 159 courtesy vehicle subject to the driver complying with the insurer’s eligibility criteria. For the avoidance of doubt, the decision of the insurer shall be final in relation to its eligibility criteria.
  6. Once their vehicle is repaired, the customer will be responsible for the return of the courtesy vehicle. AA courtesy vehicles must be returned to the AA’s rental company. Alfa 159 courtesy vehicles must be returned to a location specified by Alfa Romeo UK. If the customer does not return the AA or Alfa 159 courtesy vehicle to the required location, the customer shall be responsible for the hire costs following the repair.
  7. Benefits apply for a period of 36 months after the date of first registration only and are subject to the conditions (including any mileage limitations) of the customer’s vehicle warranty.
  8. Offer does not apply in event of the adjustment of any component or failures caused by accidental damage, misuse or neglect or which are not referred to an Authorised Alfa Romeo Dealer within 7 days; and it will terminate automatically if the customer’s vehicle is at any time modified or used for racing and rallying; or if in the odometer fitted to the customer’s vehicle appears to have been tampered with in any way; or if it is not regularly serviced in accordance with the Alfa Romeo’ Standard Service Schedule for that vehicle in force from time to time.
  9. Supply of AA courtesy vehicle is subject to rental company’s terms and conditions. Supply of Alfa 159 courtesy vehicles (“Courtesy Vehicle”) is subject to the following User Conditions:

    USER CONDITIONS
    1. The Courtesy Vehicle may not without the prior written consent of Alfa Romeo UK be removed from the territory in which it was loaned, the said territories being:
      1. England, Wales and Scotland; or
      2. Northern Ireland.
    2. Where Alfa Romeo UK does not provide insurance, the User agrees to insure the Courtesy Vehicle comprehensively and to make a claim upon its insurer in respect of any damage occurring to the Courtesy Vehicle or in respect of any claim made by a third party arising from the use of the Courtesy Vehicle. The User undertakes to use its best endeavours to attain settlement of such claims made upon its insurer immediately after the claim has arisen.
    3. The Courtesy Vehicle may not without the prior written consent of Alfa Romeo UK be used to propel or tow any other vehicle or any trailer.
    4. The Courtesy Vehicle must not be driven in a manner which would render void the insurance policy of Alfa Romeo UK which covers the use of the Courtesy Vehicle allocated under this Agreement the terms of which the User hereby acknowledges receipt of, or other contract of insurance, or in contravention of any Road Traffic Act or Construction and Use Regulations, or by any person who is not licensed to drive the Courtesy Vehicle or who is under the influence of alcohol or drugs, nor must it be driven in the event of mechanical, electrical or structural failure or damage, if further damage might thereby be caused.
    5. It is a breach of this Agreement for the User to fail to make available the Courtesy Vehicle by no later than 9am on the day and to the place specified by the Alfa Romeo UK and the User shall be liable for any cost incurred resulting from failure to comply with this Clause 5.
    6. There is no express or implied condition in taking possession of the Courtesy Vehicle entitling the User to purchase or to sell the Courtesy Vehicle without first obtaining written consent from Alfa Romeo UK and secondly, without having paid Alfa Romeo UK for the Courtesy Vehicle.
    7. Alfa Romeo UK shall be entitled to terminate the loan of any Courtesy Vehicle at any time if in its opinion it is reasonable to do so.

    OBLIGATIONS OF THE USER
    1. The User is obliged:
      1. to pay for any accessories, tyres, tools or equipment lost, stolen or damaged, to pay Alfa Romeo UK ’s costs of recovering the Courtesy Vehicle in the event that the User fails to return it to Alfa Romeo UK . Notwithstanding the provisions of clause 10 (a) of this Agreement, to pay any penalties, fines or court costs incurred in the use of the Courtesy Vehicle before it is returned to Alfa Romeo UK and which Alfa Romeo UK is obliged to pay (save when caused by the fault of Alfa Romeo UK) .
      2. to ensure that correct tyre pressures, engine oil level, battery fluid level, screen wash level, coolant level and Automatic Transmission oil level (where fitted) are maintained throughout the Loan Period;
      3. to ensure that the Courtesy Vehicle is always locked when unattended, and to take all reasonable steps to prevent loss or damage to the Courtesy Vehicle, or its tyres, tools, accessories equipment or contents;
      4. to inform Alfa Romeo UK immediately if the Courtesy Vehicle suffers any damage or loss, develops any fault or requires any servicing and to permit Alfa Romeo UK to carry out any essential repairs or servicing and to pay Alfa Romeo UK immediately the cost of repairing any damage or loss arising while the Courtesy Vehicle was in the possession of the User howsoever caused, notwithstanding that a claim has been made by the User against its insurance company;
      5. to return the Courtesy Vehicle together with its accessories, tyres, tools and equipment to Alfa Romeo UK at the place specified at or before the end of the Loan Period or on the earlier termination of this Agreement in the condition prevailing at the commencement of the loan (fair wear and tear excepted), clean and tidy (traffic grime excepted).
    2. The Courtesy Vehicle shall not be used for hire or reward without the prior written consent of Alfa Romeo UK.

    FIXED PENALTIES ETC.
    1. The User shall be liable in using the Courtesy Vehicle in respect of:
      1. any of the following offences which may be committed with respect to the Courtesy Vehicle when it is stationary and when a fixed penalty notice is issued; being on a road during hours of darkness without lights or reflectors required by law; waiting, or being left parked, or being loaded or unloaded, in a road; being used or kept on a public road within the meaning of the Vehicles (Excise) Act 1971 without a licence under that Act being exhibited on the Courtesy Vehicle in the manner prescribed under that Act; and the non-payment of the charge made at a street parking place;
      2. any excess charge which may be incurred in pursuance of an order under section 35 and 36 of the Road Traffic Regulations Act 1967 (provision on highways of parking places where charges are made); and
      3. any congestion charge except for a congestion charge arising on the day of delivery by Alfa Romeo UK if the delivery point is within a congestion charge zone. The User will be responsible for and will indemnify Alfa Romeo UK against the payment of any congestion charges (other than for the day of delivery), parking or road traffic fines which are incurred during the Loan Period.

        Congestion charges which are borne by Alfa Romeo UK as a result of non payment by the User will be recharged to the User plus an administration fee of £15 plus VAT.
      4. any offences relating to the use of hand-held mobile telephone pursuant to the road vehicles ( construction and Use) ( Amendment) (No;4) regulations 2003

  10. Offer correct at time of going to print 07/03/06. Alfa Romeo UK reserve the right to withdraw the offer at any time. Where the offer is withdrawn vehicles already registered will not be affected.
